SMS Terms of Use

Effective Date: August 2025

By opting in to or using a “Text Message Service” (as defined below) from Triumph Financial, Inc. and its associated brands, including LoadPay, (“Triumph,” “we,” “our,” or “us”), you agree to these Text Messaging Terms of Use (the “Terms”). Please read them carefully.

NOTE: THESE TERMS INCLUDE A BINDING ARBITRATION AGREEMENT AND WAIVER OF CLASS ACTION RIGHTS. SEE “DISPUTE RESOLUTION” SECTION BELOW.

 

 Definitions

  • “Opt-In” means your express consent to receive one or more text messages from Triumph, including by requesting, joining, agreeing to, enrolling in, signing up for, acknowledging, or responding to any Triumph text message.
  • “Text Message Service” refers to any program, campaign, or interaction by which Triumph sends one or more text messages (including SMS, MMS, or similar protocols) to your mobile device.

Consent to Text Messaging

 

By opting in to receive text messages from us, you agree to:

  • These Text Messaging Terms of Use;
  • Our general Terms and Conditions (if applicable); and
  • Our Privacy Policy, which is incorporated into these Terms by reference.

 

You acknowledge that your consent to receive text messages is not required as a condition of any purchase or service from us.

E-Sign Disclosure

 

By opting in, you consent to the use of electronic records to document your agreement to receive messages. You may withdraw your consent to electronic records by replying “STOP” to any text message or contacting us at the information provided below.

Text Message Service Policy Practices

 

Triumph respects your privacy. We will use the information you provide in connection with the Text Message Service only to transmit messages and respond to you. We may share information with third-party service providers who help us deliver messages (e.g., platform providers, phone carriers), but we will not sell, rent, or share your mobile number or text messaging opt-in data with third parties for marketing or promotional purposes.

 

Your use of the Text Message Service is also subject to our Privacy Policy, which governs how we collect, use, and protect your information more generally.

Costs and Charges

 

Triumph does not charge you for sending or receiving text messages. However, message and data rates may apply depending on your mobile carrier or plan. You are responsible for any such charges.

Message Frequency

 

The number of messages you receive will depend on the nature of your interactions with us. You may receive an initial welcome message followed by service-related communications. This service is designed for two-way, person-to-person communication between you and Triumph employees.

Opt-out Instructions

 

You may opt out at any time by replying with any of the following keywords: STOP, QUIT, END, CANCEL, OR UNSUBSCRIBE. Please note that because this is a person-to-person communication platform, your opt-out applies to the specific conversation and phone number involved.

 

After opting out, you may receive a final confirmation message.

Dispute Resolution and Arbitration

 

You and Triumph agree that any disputes, claims, or controversies arising out of or relating to these Terms or the Text Message Service will be resolved by final and binding individual arbitration, and not in court. You and Triumph waive the right to a trial by jury and agree that no class actions, private attorney general actions, or other representative proceedings shall be permitted.

 

All claims shall be brought on an individual basis only, and not as a plaintiff or class member in any purported class, collective, or representative action.

 

The arbitration will be administered by the American Arbitration Association (“AAA”) under its applicable rules (including the AAA Commercial or Consumer Arbitration Rules, as appropriate), and shall take place in Dallas County, Texas, unless otherwise agreed.

 

This arbitration agreement is governed by the Federal Arbitration Act (“FAA”) and shall survive termination of your relationship with Triumph. If any part of this provision is found unenforceable, the remainder shall remain in full force and effect.

 

The Terms and any disputes shall be governed by the laws of the State of Texas, without regard to conflict of law principles, and any court proceedings (where permitted) shall be brought exclusively in state or federal courts located in Dallas County, Texas.

 

Carries are not liable for delayed or undelivered messages.

Modifications

 

We reserve the right to modify or terminate the Text Message Service or these Terms at any time. Changes will be effective upon posting. Your continued use of the service after changes are posted constitutes your acceptance of those changes.
